Terms of Service
Effective August 17, 2026
TOthemovies is a listings service for independent and repertory cinema in Toronto, with optional social features (profiles, logged screenings, follows, likes). By creating an account you agree to these Terms and the Community Guidelines below.
Community Guidelines
We have no tolerance for objectionable content or abusive behaviour. When you post content — a username, bio, logged screening, or any other contribution — you agree not to submit content that is:
- Hateful, harassing, or that attacks or demeans people based on race, ethnicity, national origin, religion, sex, gender, sexual orientation, disability, or any protected characteristic;
- Threatening, bullying, or intended to intimidate another person;
- Sexually explicit, pornographic, or involving the exploitation of minors;
- Violent, graphic, or that promotes self-harm or harm to others;
- Spam, fraudulent, impersonating another person, or otherwise deceptive;
- Unlawful, or that infringes anyone else's rights.
Keeping the community safe
Everyone who uses the social features can help keep them safe:
- Report — any profile or piece of content can be reported from the app. Reports are reviewed and, where warranted, actioned within 24 hours.
- Block — you can block any user. Once blocked, neither of you sees the other's content or can interact.
We may remove content and warn, suspend, or permanently remove accounts that violate these guidelines, at our discretion. Serious violations may be removed immediately and without notice.
Your account
You are responsible for activity on your account and for keeping your credentials secure. You must be at least 13 years old to use TOthemovies. You can delete your account at any time from Settings.
Accuracy of listings
Not all information presented on TOthemovies may be accurate or up to date. As such, users are advised to verify any pertinent information (including but not limited to: showtimes, films, theatres, locations) with the relevant venue(s).
Supporter and Member
Not yet available. Supporter and Member are described here so the terms are in place before they launch, but neither is currently offered: there is nothing to buy in the app, no payment can be taken, and no badge or alert limit is affected. Where the app currently shows a “Support us” button, it opens an external page in your browser and is a voluntary contribution that grants nothing in the app — the rest of this section does not apply to it. This notice will be removed when in-app purchase goes live.
TOthemovies is free to use, and the listings stay free. Inside the iOS app you can optionally pay to support the service through Apple's In-App Purchase:
- Supporter — a one-time payment of CA$4.99. It adds a Supporter badge to your handle and may be repeated as often as you like. It does not unlock or change any feature.
- Member — an auto-renewing subscription of CA$1.99 per month. It adds a Member badge and removes the limit on how many film alerts your account may keep. You can cancel at any time.
Purchases are processed by Apple and charged to your Apple Account at confirmation. A Member subscription automatically renews at CA$1.99 each month until you turn off auto-renewal; your Apple Account is charged for the renewal within 24 hours before the current period ends, unless auto-renewal is turned off at least 24 hours before that time. Prices may vary by region and are shown in Apple's purchase screen before you buy.
You can view, manage, or cancel a subscription at any time in Settings → [your name] → Subscriptions on your device. Cancelling stops future renewals; your Member benefits continue until the end of the period you have already paid for. Deleting the app does not cancel a subscription.
Supporter and Member are tied to your TOthemovies account, not to a device. If a Member subscription lapses, alerts beyond the free limit are paused, never deleted, and resume automatically if you subscribe again. These payments help cover hosting and film-data costs; they are not charitable donations. TOthemovies is not a registered charity and no tax receipt is issued.
A Supporter badge, once granted, stays with your account. If you are both a Supporter and a Member, the two are shown together as a single badge — your Member badge with an outline representing your Supporter status — rather than as two separate badges. The particular way Supporter or Member status is represented on your profile may change over time.
Refunds
All purchases are made through Apple's App Store, and refunds are handled by Apple under the App Store Terms of Service — TOthemovies cannot issue refunds directly. To request a refund, use Apple's process at reportaproblem.apple.com. Except where a refund is required by applicable law, payments are otherwise non-refundable.
Content and intellectual property
TOthemovies — its name, design, and original content — is ours and is protected by law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app and service for their intended purpose. Film titles, posters, metadata, and venue information belong to their respective owners; film metadata and images are provided by TheTVDB, and this product uses the TheTVDB API but is not endorsed or certified by TheTVDB.
You keep ownership of what you post (your username, bio, logged screenings, and other contributions). By posting it you grant us a worldwide, royalty-free licence to host, display, and distribute that content within the service so it works as intended — for example, showing your logged screenings to the people who follow you. You are responsible for your content and confirm you have the right to post it.
Changes and termination
We may update these Terms from time to time. When we do, we will change the effective date above and, for material changes, give reasonable notice; continuing to use the service after a change means you accept the updated Terms. We may modify, suspend, or discontinue any part of the service at any time. You may stop using the service and delete your account whenever you like, and we may suspend or remove an account that violates these Terms or the Community Guidelines, as described above.
Disclaimers and limitation of liability
The service is provided “as is” and “as available,” without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that it will be uninterrupted or error-free, or that listings are accurate — always verify showtimes and details with the venue. To the fullest extent permitted by law, TOthemovies will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of, or inability to use, the service. Nothing in these Terms limits rights you have that cannot be limited by law.
Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-laws rules. Disputes will be subject to the courts located in Ontario, except where applicable law gives you the right to bring a claim elsewhere.
Apple
The iOS app is licensed, not sold, to you, for use only under these Terms. This agreement is between you and TOthemovies only, not with Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app and no warranty obligation with respect to it. Apple is not responsible for addressing any claims relating to the app — including product liability, a failure to conform to any legal or regulatory requirement, consumer-protection claims, or a third-party claim that the app infringes intellectual-property rights. You must comply with applicable third-party terms, including Apple's, when using the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
